Article: The rule of law in the health care sector Author: Tom André Tveit, Bergen, 24.06.2020 Today is the health care sector put togheter in such a way that one can become unwillingly and illegaly a prisoner by use of force from the health sector - it will in the reality be placed beneath illegal detention. The rule of law for every norwegian is in danger. The problem is that it is a lack on control and critical judgement on decisions taken on wrong grounds, and until further notice the problems attached especially the psychiatric health care law: Let us pretend one from Bergen takes a four week vacation in a place in 'Sogn og Fjordane', and furtherly gets bad relations to a local with a public profession; which in the following attempts to gather false accusations about the vacator which furtherly becomes delivered false concerns about to a local doctor - in the following after a while later gets invited to a conversation with the doctor and in the conversation gets an illegal decision againt itself that has to do with force. The police and an ambulanse could then be expected contacted if they do not reveal the offense as else could be difficult to self decide for other than the doctor itself - as in the following transports the vacator with force to a psychiatric institution. With this as an origin is the health care system slow with to could reveal errors and illegal decisions but the fact that is expected weeks until the case is treated juridicially, which can result in the worst case the one innocent juridicially and mentally with its good health, can come to be present under force in a longer period. It can in addition be added if such events often happen the employers which experience such can become frightened of the truth and the danger for such illegal use of force that they themselvses will attempt to hide the truth by denying communication with the external environment. The picture is brutal - in spite of this a fact and real possibility until the law becomes followed in every aspect, and that we have no guarantee for; the rule of law in the health care sector is therefore something which must be worked on! Noone from in example bergen has therefore good security for that in such an event would get its rights followed - and that applies accordingly citizens in every other place after what is known. The municipals, also ones regular doctor has a responsibility to secure that such situations do not happen in the immediate, control commissions and count medicals by 'Fylkesmannen' after a certain period - then in addition to the general responsibility all involved has to follow the law in those events along they are connected and eventually change errors they themselvses have done. Everyone in Norway is being adviced to generally be enlightened about ones rights - in the worst cases about illegal imprisonment as mentioned, it is adviced also to have a plan ready for asylum in another country - if one see a danger about getting caught illegally with force, one can become illegally imprisoned a longer period because of slow treatment of complaints (!) - and the lack of rhyck. |
